The draft of the new Constitution: today's change, tomorrow's development
The draft of the new Constitution of the Republic of Kazakhstan is the beginning of a very important and fateful period in the country's history. This document is aimed at strengthening the sovereignty and independence of the state, modernizing the political system and forming a new model of social development.
The summary project proposed by the Commission on Constitutional Reform consists of the Preamble, 11 parts and 95 articles. In the project, two new sections "People's Council" and "Amendments to the Constitution" were introduced, and the names of 4 other sections were changed. In general, 77 articles of the Constitution were amended, and 84 percent of the main text was updated. This shows that it is a large-scale reform aimed at radical modernization of the Constitution.
According to the new edition, the Republic of Kazakhstan is a unitary state and the form of government is clearly defined as a presidential republic. Sovereignty and territorial integrity were established as unshakable and basic values of the state. In addition, Article 4 clearly states that the sole source of state power and the owner of sovereignty is the people of Kazakhstan. The concept of "republican referendum" was changed to "general referendum", and the mechanisms of direct participation of the people in the country's governance were strengthened.
The beginning of this reform was raised in the Address of the Head of State Kassym-Jomart Tokayev to the people of Kazakhstan on September 8, 2025. The President emphasized the need to comprehensively modernize the political system of the country, to give a new impetus to the socio-economic development of Kazakhstan in the era of artificial intelligence and digital technologies.
One of the main priorities of the draft of the new Constitution is to strengthen the protection of the rights and freedoms of citizens, ensure the rule of law and create a just society. At the same time, special attention is paid to the issues of increasing the balance and responsibility between the branches of government, developing local self-government and strengthening the role of civil society institutions.
In the new text of the Constitution, education and science, culture and innovation are considered as the main pillars of the state's strategic development. Acceleration of digitization processes, support of scientific research, formation of innovative ecosystem and improvement of quality of human capital are defined as decisive factors ensuring the country's competitiveness. These directions, in particular, increase the responsibility of higher education organizations and scientific institutions and strengthen their role in national development.
The publication of the draft of the new Constitution and submission to the public discussion is a historic step towards the creation of a new Kazakhstan based on education, science and innovation, which paves the way for active participation of the people in state governance.
